Idaho Attorney General appeals federal abortion health exception ruling

Idaho Attorney General Raúl Labrador has filed an appeal and an emergency motion following a federal court ruling regarding the state’s abortion restrictions. The legal challenge follows a decision by U.S. District Judge B. Lynn Winmill, who ruled in favor of a lawsuit brought by Boise physician Stacy Seyb.

Judge Winmill declared that the Fourteenth Amendment provides a “narrow but fundamental right to abortion when a pregnancy threatens the woman’s life or health.” This ruling addresses the distinction between Idaho’s current law, which allows exceptions to prevent the death of a pregnant woman, and the broader inclusion of “health” as a justification for the procedure.

Labrador is appealing to the Ninth Circuit, arguing that the judge’s standard is too broad and allows for the circumvention of state law. Legal experts suggest this case could eventually reach the U.S. Supreme Court and may represent a significant shift in the legal landscape following the 2022 Dobbs decision, potentially impacting how abortion exceptions are interpreted nationwide.
