Idaho prosecutors seek death penalty for mother charged in twins' deaths

Prosecutors in Payette County, Idaho, have filed a notice of intent to seek the death penalty against Andrea Shaw, who is charged with the first-degree murder of her twin 18-month-old toddlers. The deaths occurred in May 2025.

Shaw has pleaded not guilty to the charges. Her defense maintains that the children became severely ill and died following a “post-immunization reaction” to routine vaccinations and flu shots received days prior to their deaths. However, Payette County Prosecutor Mike Duke stated in court documents that autopsy results showed symptoms consistent with smothering, asserting that suffocation is the “only conceivable explanation” for the deaths.

Deputy Prosecuting Attorney Ryon Sirucek identified four statutory aggravating factors to justify capital punishment: that the murders were committed at the same time; that the killings were “especially heinous, atrocious, or cruel”; that the defendant exhibited “utter disregard for human life”; and that she poses a continuing threat to society. If convicted, a jury will determine the existence of these circumstances.
