Idaho murder case of Andrea Shaw

Overview

Prosecutors in Payette County, Idaho, have filed a notice of intent to seek the death penalty against Andrea Shaw, who is charged with the first-degree murder of her 18-month-old twin toddlers. The deaths occurred in May 2025.

Shaw has pleaded not guilty. Her defense maintains that the children died following a “post-immunization reaction” to routine vaccinations and flu shots. In response, Payette County Prosecutor Mike Duke stated that autopsy results showed symptoms consistent with smothering, asserting that suffocation is the “only conceivable explanation” for the deaths.

To justify capital punishment, prosecutors identified four aggravating factors: that the murders were committed simultaneously; that the killings were “especially heinous, atrocious, or cruel”; that the defendant exhibited “utter disregard for human life”; and that she poses a continuing threat to society.

Following the announcement, Shaw’s defense team filed a motion to dismiss the indictment, alleging prosecutorial misconduct. The defense claims prosecutors failed to disclose evidence to the grand jury indicating that the county coroner and pathologists had found the causes of death to be undetermined, though consistent with hyperthermia or overheating.
