Idaho prosecutors seek death penalty for mother charged in twins' deaths
Prosecutors in Payette County, Idaho, have announced their intent to seek the death penalty against 23-year-old Andrea Shaw, who is charged with the first-degree murder of her 18-month-old twin toddlers. The state argues that an autopsy revealed symptoms consistent with smothering, claiming suffocation is the “only conceivable explanation” for the deaths.
Shaw has pleaded not guilty, alleging that the children became ill and died following routine childhood vaccinations and flu shots. Her defense team has filed a motion to dismiss the indictment, alleging prosecutorial misconduct. Attorneys for Shaw claim that prosecutors failed to disclose evidence to the grand jury, specifically that the county coroner and pathologists found the causes of death to be undetermined, though consistent with hyperthermia or overheating.
If convicted, the state intends to present four aggravating factors to justify capital punishment: that multiple murders were committed simultaneously, the killings were especially heinous, atrocious, or cruel; the defendant showed “utter disregard” for human life; and she poses a continuing threat to society.
