India CBIC issues new GST reforms and regulatory clarifications
The Central Board of Indirect Taxes and Customs (CBIC) has issued several directives and clarifications regarding the Goods and Services Tax (GST) framework in India. Following recommendations from the 57th GST Council meeting, the CBIC has introduced interim measures to ease compliance. These include instructions to GST officers to cease arrests, restrict random vehicle inspections, and avoid issuing show-cause notices for amounts below Rs. 10,000 pending legislative amendments.
New regulatory clarifications address the distinction between research and development (R&D) services and consultancy services to ensure consistent tax application. Additionally, the CBIC clarified that the Telecom Regulatory Authority of India (TRAI) does not qualify as the Central Government under the CGST Act, affecting how regulatory fees are treated under the Reverse Charge Mechanism (RCM).
Effective November 1, 2026, several rule changes will take effect, including revised input tax credit (ITC) conditions for the hotel, catering, and electric vehicle transport sectors. The government also aims to simplify rules for post-sale discounts and accelerate provisional refunds for businesses facing an inverted duty structure.
