India GST reform implementation

Overview

The Indian government has initiated a phased implementation of Goods and Services Tax (GST) reforms. Following recommendations from the 57th GST Council meeting, reforms not requiring legislative changes began on November 1, 2026. Major statutory changes involving Central and State GST law amendments remain targeted for April 1, 2027.

As of November 1, 2026, the Central Board of Indirect Taxes and Customs (CBIC) has implemented several administrative measures to foster a trust-based economic environment and reduce the compliance burden. These include the withdrawal of arrest powers under Section 69 of the CGST Act pending legislative amendments. To minimize litigation, field officers have been instructed to cease issuing show-cause notices for amounts below Rs. 10,000 and to restrict unnecessary vehicle interceptions for e-way bill verification.

Significant changes to prosecution thresholds have been introduced, with the monetary limit increasing fivefold from Rs. 1 crore to Rs. 5 crore. Additionally, new rules simplify registration for small e-commerce sellers: suppliers without a physical presence in multiple states may now declare an e-commerce operator’s warehouse as their principal place of business, provided their monthly output tax liability does not exceed Rs. 2.5 lakh. The Confederation of Indian Industry (CII) has described these measures as significant institutional reforms that help distinguish genuine commercial disputes from deliberate tax evasion.

Further updates effective November 1, 2026, include revised GST rates for electric vehicle passenger transport and updated definitions for Goods Transport Agencies (GTA). Under Notification No. 04/2026-Central Tax (Rate), the scope of the Reverse Charge Mechanism (RCM) has been expanded. Registered persons must now discharge GST liabilities when procuring specific goods from unregistered suppliers, including used cooking oil, plastic waste and scrap, tyre waste and scrap, and electrical or electronic waste and scrap. New TDS obligations under Section 51 have also been introduced.
