India debates strengthening domestic arbitration framework

Legal experts and members of the judiciary are debating the future of India’s arbitration framework, focusing on the need for institutionalization, predictability, and reduced judicial intervention. During the GHAC Arbitration Week 2026, senior judges discussed the necessity of creating a system that ensures speed, cost-effectiveness, and finality in commercial disputes.

Parallel discussions have highlighted a growing concern regarding India's reliance on foreign arbitration centers. Supreme Court Justice Manmohan noted a disparity in participation at the Singapore International Arbitration Centre (SIAC), where India contributed 178 references last year but received only approximately 31 tribunal seats.

As India’s economy expands, legal professionals are questioning whether the country can become a global economic powerhouse while continuing to export its commercial disputes to hubs like Singapore, London, and Hong Kong. The debate emphasizes the need for India to develop a globally trusted domestic arbitration ecosystem to match its economic sophistication.
