India's economic and arbitration framework development

India is working to establish itself as a global hub for commercial arbitration and a resilient, enterprise-led economy through structural and digital reforms. Efforts to improve the ‘Ease of Doing Business’ include the National Single Window System and AI-driven projects to enhance corporate transparency.

Recent discussions at the GHAC Arbitration Week 2026 and India ADR Week 2026 have intensified the debate over the nation’s legal framework. Legal experts and members of the judiciary are emphasizing the need for institutionalization, predictability, and reduced judicial intervention to ensure speed and cost-effectiveness. Concerns persist regarding India’s reliance on foreign hubs; Supreme Court Justice Manmohan noted a significant disparity at the Singapore International Arbitration Centre (SIAC), where India provided 178 references last year but received only approximately 31 tribunal seats.

Leadership has also called for urgent regulatory and scheduling reforms. Chief Justice of India Surya Kant highlighted a six-year delay in the formation of the Arbitration Council of India, urging the community toward self-regulation and the creation of a public disclosure register for arbitrators. Additionally, Solicitor General Tushar Mehta addressed delays caused by arbitrator availability, suggesting that institutions implement mechanisms to verify calendars before appointments to ensure proceedings meet statutory timelines. These developments underscore the push to shift from ad hoc models toward a more robust, domestically trusted institutional arbitration ecosystem that matches India’s economic sophistication.
