Indiana Recount Commission Denies Voter Subpoenas in Senate District 23 Primary

The Indiana Recount Commission voted 2‑1 to reject a request by Republican challenger Paula Copenhaver to subpoena and depose eleven voters who allegedly posted about voting for incumbent Senator Spencer Deery in the tightly contested State Senate District 23 Republican primary. Secretary of State Diego Morales joined the two commissioners in opposing the motion, stating that voter challenges belong at the polls.

The commission also denied other subpoenas and deposition requests, effectively ending Copenhaver’s strategy to question individual voters under oath. The underlying election contest continues, with a margin of only three votes confirmed by a state audit—Deery leading 6,337 to 6,334. The commission preserved Copenhaver’s objection to the certified vote count correction, scheduling further hearings.
