Indiana Senate District 23 recount flips primary result

The Indiana Recount Commission has overturned the results of the Republican primary for Senate District 23, declaring challenger Paula Copenhaver the winner over incumbent Spencer Deery. This decision reverses the initial certification, which had shown Deery leading by three votes.

The reversal follows a review of the May 5 election. The commission disqualified eight ballots originally cast for Deery due to clerical errors, specifically the absence of required signatures from the county clerk or initials from both Republican and Democratic election judges. Although two ballots for Copenhaver were also rejected for similar reasons, the net result shifted the lead to Copenhaver by three votes, giving her 6,332 votes to Deery’s 6,329.

This outcome concludes a period of intense legal maneuvering. Previously, the commission had voted 2–1 to deny Copenhaver’s requests to subpoena eleven voters and to depose Tippecanoe County Clerk Julie Roush. During those proceedings, Copenhaver’s counsel had raised concerns regarding the chain of custody for an absentee ballot processed after Election Day. While the clerk defended her staff against allegations she termed “misinformation,” and voting-rights advocates warned that “the secrecy of one’s ballot is just basic to the American voting process,” the commission ultimately focused on the clerical errors in the ballot signatures.

Copenhaver, who received an endorsement from Donald Trump, had challenged the original results citing election integrity concerns. She was part of a wave of Trump-backed challengers targeting incumbents who opposed a redrawn congressional map. Deery, who opposed the redistricting plan, has criticized the commission, alleging the decision was designed to further political goals rather than ensure fairness. Deery’s legal counsel has indicated plans to appeal the commission's decision to the Indiana Court of Appeals.
