Indonesia advances corporate deferred prosecution guidelines amid new criminal code rollout

Indonesia’s Attorney General’s Office is drafting a set of guidelines for Deferred Prosecution Agreements (DPA) to allow corporations to settle cases without immediate prosecution. The move comes six months after the new Criminal Code (KUHP) and Criminal Procedure Code (KUHAP) took effect. Attorney General Burhanuddin noted that implementation has revealed both strengths and shortcomings, saying, “Selama implementasi enam bulan ini, banyak hal yang bisa kita rasakan, ada kelebihan dan kekurangannya.” He highlighted that the revised codes shift toward restorative justice and due‑process protections, expanding rights for suspects, victims, and disabled persons. The DPA mechanism was cited as an “alternative that enables fair and efficient case resolution without neglecting victims or public interests.” The guidelines aim to provide certainty for businesses while aligning with the broader legal reforms.
