Indonesia’s Constitutional Court (Mahkamah Konstitusi) delivered its ruling on 30 July 2026 that the Makan Bergizi Gratis (MBG) programme may no longer be funded from the education component of the state budget (APBN). The court held that the explanation of Article 22(3) of Law No 17/2025, which allowed MBG to be treated as part of operational education spending, applies only to the 2026 APBN. Consequently, the government must separate MBG funding from the education budget for all subsequent fiscal years, with the deadline set at the 2028 APBN or within two years of the decision.

The ruling concerns case No. 40/PUU‑XXIV/2026 filed by Yayasan Taman Belajar Nusantara together with individual plaintiffs Reza Sudrajat, Sa’ed Sipghotulloh Mujaddidi, and Felix Rega. The court also decided on two related petitions (numbers 55 and 52) that raised the same issue. In 2025 the total education allocation was Rp 769 trillion, of which Rp 223.6 trillion was earmarked for MBG, representing a significant share of the mandatory 20 percent education spending required by the constitution. Judges Chief Justice Suhartoyo and Judge Enny Nurbaningsih read the decision, ordering the separation to be published in the State Gazette.
