Italian local tax regulations and debt settlement measures
Recent rulings from the Italian Court of Cassation regarding the IMU (municipal property tax) indicate a trend toward increased taxpayer protection, which may impact the financial stability of local authorities. Key legal developments include rulings that allow for IMU exemptions even when a portion of a primary residence is rented to students, and decisions regarding the transfer of tax obligations through private agreements. Additionally, the court has addressed whether owners must declare agricultural land that has been reclassified as building land for IMU purposes.
In a separate development regarding local tax recovery, the municipality of Ladispoli has become one of the first Italian local entities to adopt the ‘Rottamazione Quinquies’ measure. This program allows citizens and businesses to settle outstanding debts for IMU, TARI (waste tax), and other local taxes by waiving penalties and interest. The measure covers debts assigned to the Revenue Agency from January 1, 2000, to December 31, 2023, and offers the possibility of paying arrears in up to 54 bi-monthly installments.
