Italy addresses disability rights in education and recreation

Recent legal and administrative developments in Italy have addressed the rights of students with disabilities to receive continuous educational and recreational support.

In Bari, the family of a 17-year-old student with severe disabilities at the I.T.T. ‘E. di Savoia – F. Caracciolo’ has secured a solution to ensure educational continuity. Following appeals to the Ministry of Education and Merit and regional disability rights advocates, the student will be able to continue his studies with his current support teacher through his final year of high school via reasonable accommodation.

Separately, the Civil Court of Bologna ruled that excluding a child with disabilities from summer camp swimming activities due to a lack of support staff constitutes ‘indirect discrimination’. The case arose after a child was unable to participate in Friday excursions and pool sessions because authorized support hours did not cover those specific days. The court's decision emphasizes the necessity of providing adequate support to ensure equal access to recreational activities.
