Italy adopts new motor‑insurance subrogation limits

In early 2024 Italy introduced rules restricting subrogation claims under RC (civil liability) policies when several insurers cover the same accident. The updated Motor Insurance Directive (2023/142) and an IVASS ruling require the insurer that pays a claim to seek only proportional reimbursement from other liable insurers, based on each policy’s coverage limits and the fault share, and to limit recovery to the amount actually paid after any contributions.

The reform aims to speed payouts, cut litigation – previously accounting for about 18% of motor‑insurance disputes – and lower administrative costs, projected at up to 15% of insurers’ expenses. insurers must disclose liability splits within 30 days and settle claims within 90 days, potentially passing savings to policyholders through lower premiums.
