Italy beach concessions face legal uncertainty and new auction processes
The management of Italian beach concessions is facing significant regulatory uncertainty following recent rulings by the Tar Lazio and the Consiglio di Stato. In the Fermano region, local businesses are navigating complex legal landscapes regarding the validity of extension acts and the distinction between various types of maritime licenses. While some municipalities, such as Porto San Giorgio, have utilized previous extension acts to secure concessions, others face the prospect of mandatory public auctions.
In Rimini, preliminary auctions for beach areas dedicated to sunbeds and umbrellas are serving as a test case for the broader transition expected in 2027. For 27 specific areas totaling 107,000 square meters, 38 bids have been submitted, including interest from companies based in Rome and Milan. These initial auctions include economic caps to ensure that the highest bidder does not automatically win, as the areas are limited to equipment rental rather than full business operations.
