Italy: Legal rulings on civil liability and compensation

Legal principles in Italy clarify the distinction between criminal and civil proceedings regarding compensation for damages. In the event of a road accident involving injuries, criminal proceedings aim to punish the offender, while civil proceedings focus on compensating the victim for physical or property damage. An acquittal in a criminal court does not automatically prevent a victim from seeking financial compensation in a civil court, as civil judges can evaluate facts independently under different evidentiary standards.

Furthermore, the Italian Supreme Court (Corte di Cassazione) has reaffirmed the liability of public entities for damages caused by goods under their custody. In a recent ruling regarding a pedestrian who fell on public stairs, the Court determined that a municipality remains liable for injuries unless it can prove a ‘fortuitous event.’ The mere distraction or imprudence of a pedestrian is insufficient to exempt the municipality from responsibility unless the behavior is so anomalous and unpredictable that it becomes the primary cause of the accident.
