Regarding road accidents, Article 2054 of the Civil Code presumes drivers are responsible for damages unless they can prove a ‘caso fortuito’ (fortuitous event). Such events must be extraordinary, unpredictable, and unavoidable, such as a sudden, acute medical emergency or a tire exploding.

Furthermore, judicial precedents have clarified compensation rights for vehicle damage. While insurance companies often offer settlements based on a vehicle’s market value, Article 2058 of the Civil Code allows for ‘specific performance.’ This grants owners the right to demand actual repairs even if the costs exceed the vehicle’s commercial value.
