Jair Bolsonaro's defense seeks to annul coup conviction via STF

Jair Bolsonaro's legal team has filed a new criminal review request with the Brazilian Supreme Federal Court (STF) to annul his 27-year and three-month prison sentence for leading a coup attempt.

The petition, filed on September 25, seeks the immediate suspension of his sentence. Bolsonaro is currently serving his term under humanitarian house arrest due to chronic health issues.

A central argument in the request is a technical report alleging irregularities in the chain of custody of digital evidence used during his trial. The defense claims that the integrity of the data, including messages from the Signal app, could not be fully verified. Furthermore, lawyers argue they were not granted sufficient time to conduct a thorough technical audit of the digital files during the original proceedings.

The defense also cites recent statements by STF Minister Alexandre de Moraes in an unrelated case involving Banco Master, arguing that the court has acknowledged the necessity of adequate time and full access to evidence—procedural guarantees they claim were denied to Bolsonaro.
