Jammu and Kashmir High Court quashes detention and opens Delhi office

The Jammu and Kashmir and Ladakh High Court has issued two significant rulings and administrative orders. First, Justice Sanjay Dhar quashed the preventive detention of Mohd Yousuf under the Public Safety Act. The court ruled that the District Magistrate of Poonch failed to distinguish between “public order” and “law and order,” noting that extraordinary detention powers should only be used for emergent situations rather than individual disputes that can be handled by existing criminal law.

Separately, the High Court has sanctioned the establishment of a resident office in New Delhi. This office is intended to improve coordination with the Supreme Court and the Union government. Managed by a designated Registrar (Headquarters), the Delhi office will handle confidential communications, maintain liaison with the Department of Justice, and monitor the progress of cases involving the High Court to ensure timely compliance with Supreme Court directions.
