JSW to seek legal action after Minister of Energy denies 1.6 billion PLN tax refund
The Polish Minister of Energy has issued a final administrative decision refusing to refund approximately 1.6 billion PLN in solidarity contributions to Jastrzębska Spółka Węglowa (JSW).
The solidarity contribution was introduced in 2023, targeting extraordinary profits from coal mining and coke production for companies with more than 3,000 employees. Due to these specific criteria, JSW was the only company subject to the levy. The company paid the contribution in 2023 and made additional payments in 2024.
JSW, the largest producer of coking coal in the European Union, is currently facing significant financial difficulties. After reporting a net profit of 7.6 billion PLN in 2022, the company saw profits drop sharply, recording a net loss of 7.3 billion PLN in 2024. The company's management has announced plans to pursue legal remedies to recover the funds.
