Elon Musk's companies ordered to disclose Apple settlement
A federal judge in Texas, Mark Pittman, has ordered Elon Musk’s companies, X Corp and SpaceXAI, to disclose the details of a settlement agreement with Apple. This order follows an emergency motion by OpenAI, which seeks to understand the terms that led Musk’s firms to drop their antitrust claims against Apple while maintaining their lawsuit against OpenAI.
The original antitrust litigation alleged that Apple and OpenAI were colluding to dominate the artificial intelligence market by integrating ChatGPT into Apple Intelligence, potentially disadvantaging competitors like Grok. While Musk’s companies have moved to dismiss claims against Apple, the legal battle with OpenAI remains active.
In a separate legal development, the U.S. International Trade Commission (ITC) has launched an investigation into Apple, Samsung, and Google regarding alleged patent infringements. The investigation, initiated by BoomCloud 360, concerns audio processing and spatial audio technologies used in various electronic devices. If the ITC finds violations, it could issue orders to restrict the import or sale of certain products in the United States.
Additionally, the U.S. Ninth Circuit Court of Appeals upheld a ruling that OpenAI and Microsoft are not liable under the Digital Millennium Copyright Act (DMCA) for using GitHub code to train AI tools, noting that the generated outputs did not remove existing copyright management information.
