Apple lawsuit deepens OpenAI‑Musk feud and IPO stakes
Overview
OpenAI and Broadcom kept rolling out their 3‑nm Jalapeño AI‑accelerator after the July 5 launch, aiming for data‑centre deployment before year‑end. On July 9 a coalition of roughly 400 U.S. newspapers moved to sanction OpenAI and Microsoft for alleged evidence‑tampering in a separate case.
Apple filed a federal complaint on July 10 2026 in the Northern District of California, accusing OpenAI, its hardware chief Tang Tan, former Apple engineer Chang Liu and the startup io Products (acquired for about $6.4 billion) of a coordinated scheme to steal hardware trade secrets. The suit alleges Liu kept a company laptop, exploited a previously unknown authentication bug and downloaded dozens of confidential files on unreleased iPhone, Apple Watch and other products, even sending a message “LOL, I found out I can access the network storage, so funny.” It also claims OpenAI instructed job candidates to bring actual Apple parts to interviews and coached departing employees, including recruiting Yu‑Ting Peng, to evade Apple’s security procedures. Apple seeks damages, an injunction to halt use of the alleged secrets, destruction of any derived material and redesign of any hardware that incorporates the data, warning that the case could delay OpenAI’s AI‑powered device slated for 2027.
The filing reignited the public feud between Elon Musk and OpenAI chief Sam Altman on X. Musk revivified his “Scam Altman” nickname, while Altman mocked Musk’s orbital data‑centre plan. Both highlighted their latest models—Musk’s xAI released Grok 4.5 and OpenAI unveiled GPT‑5.6 Sol—as they prepare major market moves.
SpaceX completed a record‑breaking $75 billion IPO, and OpenAI has confidentially filed for its own listing. Analysts warn that a court‑ordered injunction could impede OpenAI’s consumer‑hardware launch and add uncertainty to its pending IPO and the broader AI‑hardware race.
