Kosovo Specialized Constitutional Court rejects Pjetër Shala's appeals
The Specialized Chambers of the Kosovo Constitutional Court has ruled on the referral request made by Pjetër Shala, declaring several of his complaints inadmissible and finding no violations of the Kosovo Constitution or international human rights conventions regarding his other claims.
Shala had raised multiple allegations concerning his criminal proceedings, including the length of time between the alleged crimes and his trial, arguing it compromised the fairness of the process. The Chamber determined that Shala benefited from an adversarial judicial process and that the proceedings were overall fair and non-arbitrary. Some parts of this complaint were ruled inadmissible due to the expiration of legal remedies.
Additionally, Shala challenged the use of statements made to the International Criminal Tribunal for the former Yugoslavia and the Belgian Federal Judicial Police while he was a suspect without legal representation. The Chamber noted that Shala had numerous opportunities to contest these statements and that they were not decisive in his conviction.
Regarding the principle of legality, the Chamber found that the legal basis for joint criminal enterprise and the war crime of arbitrary prohibition were sufficiently established under international customary law and existing legal frameworks at the time.
