Kosovo parliament passes amendments to limit Specialist Chambers powers

The Kosovo parliament has approved amendments to the law governing the Kosovo Specialist Chambers, a Hague-based court. These changes follow the recent convictions of former KLA leaders, including Hashim Thaci, who received a 25-year sentence for war crimes.

The new legislation aims to narrow the court's jurisdiction, reduce maximum prison sentences to 15 years, and grant the Kosovo President the authority to issue pardons. While the ruling Vetëvendosje movement supported the move, they expressed skepticism regarding its actual effectiveness in influencing the Hague-based proceedings.

International reactions have been critical. The European Union stated the law conflicts with Kosovo's international obligations. Legal experts, including former Constitutional Court President Enver Hasani, have suggested the Constitutional Chamber of the Specialist Court might annul the law, noting that a state cannot fully transfer its sovereign will to another mechanism. Additionally, academic Edward Joseph criticized the EU's public approach to the matter, suggesting concerns should have been handled privately.

Defense teams for the convicted leaders have announced plans to challenge the original verdicts, while the legal community remains divided on whether these domestic legislative changes can legally impact an international judicial mandate.
