TSE President Kassio Nunes Marques challenges STF interference
Kassio Nunes Marques, president of the Superior Electoral Court (TSE), has formally complained to the Supreme Federal Court (STF) regarding what he describes as an ‘undue overlap of competence’ and interference in electoral justice decisions.
The conflict escalated after STF Minister Flávio Dino overturned a TSE decision by Minister André Mendonça. Mendonça had ordered the removal of social media posts containing false information about candidate Flávio Bolsonaro and religious imagery of Nossa Senhora Aparecida. Dino restored the posts following a request from comedian Antonio Tabet, citing freedom of expression.
In an official letter to STF President Edson Fachin, Nunes Marques warned of the ‘risk of institutional capture,’ where the TSE could become functionally subordinate to individual decisions made outside the electoral court structure. He argued that such interference undermines the principle of the ‘natural judge’ and creates legal uncertainty during critical election periods. To mitigate this, Nunes Marques proposed that the STF implement a screening mechanism for urgent petitions related to elections to prevent them from being diverted to specific rapporteurs through unrelated ongoing cases.
