Kwabena Adu-Boahene defense seeks discharge in GH¢49.1 million misconduct case

Defense counsel Samuel Atta Akyea has filed a ‘no-case’ submission in the High Court in Accra, requesting the discharge of former National Signals Bureau (NSB) Director-General Kwabena Adu-Boahene. The defense argues that the prosecution has failed to provide sufficient evidence to require the accused to present a defense, citing significant evidential gaps and inconsistencies.

Mr. Adu-Boahene, his wife Angela Adjei-Boateng, and another individual are facing charges of embezzlement and financial misconduct involving approximately GH¢49.1 million ($7 million). The State alleges the funds were intended for the procurement of a cyber defense system from an Israeli company, ISC, in 2020, but were instead diverted into an account linked to BNC Communications Bureau Limited.

The prosecution claims the diverted funds were used to purchase luxury vehicles and real estate. However, during cross-examination, an investigator from the Economic and Organised Crime Office (EOCO) confirmed that the agency did not contact ISC or the National Security Council to verify if the system had been purchased or delivered. The defense has until September 25 to file its submission, after which the Attorney-General has 14 days to respond.
