La Plata court orders multinational to pay 659.8 million pesos for unregistered labor
The Labor Court No. 5 of La Plata has issued a significant ruling against a multinational corporation, recognizing an unregistered labor relationship with a transporter from Saladillo. The court ordered the company to pay 659.8 million pesos, including updates and interest.
The ruling determined that the worker's status, which had been disguised through service contracts and invoicing as a 'monotributista' and later a 'Responsable Inscripto', was actually a concealed employment relationship. In addition to the financial penalty, the company is required to provide employment certification and declare the relationship to the tax authority (ARCA).
Legal experts noted the importance of the ruling regarding the interest rates applied and the court's determination of the unconstitutionality of certain aspects of the law to prevent labor fraud and the evasion of social security and health benefits.
