Legal scholars challenge U.S. sanctions against the ICC
Legal scholars and practitioners have filed an amicus brief in a federal case challenging United States sanctions against the International Criminal Court (ICC). The challenge targets an executive order issued by President Donald Trump in February 2025, which authorizes sanctions against individuals and organizations linked to specific ICC investigations.
Leila Sadat, a professor of international criminal law at Washington University in St. Louis, argues that these sanctions are unlawful and pose a significant threat to academic freedom. According to the brief, the restrictions chill research, teaching, and collaboration with international legal institutions and United Nations experts.
Furthermore, the sanctions may limit professional opportunities for law students, including internships and career paths involving international law. The executive order prohibits providing services to or for the benefit of designated persons, carrying both civil and criminal penalties.
