Legal systems face new challenges from AI and social media
Legal experts and judicial bodies are addressing the challenges posed by digital transformation and artificial intelligence in the justice system. In Spain, the Civil and Criminal Chamber of the High Court of Justice of Andalusia (TSJ) has issued a warning regarding the use of generative artificial intelligence in appeal resources. While the court does not prohibit the use of these tools, it cautioned that AI-generated documents must not substitute for legal reasoning or substantive argumentative density, which is required by constitutional and procedural law.
Additionally, legal analysis highlights how social media, YouTube, and digital platforms are changing the consumption of news. This shift toward involuntary content suggestion and the use of AI-assisted content created by citizens poses new risks to the right to a fair and impartial trial, as such information can reach jurors passively. Current jurisprudence, largely focused on traditional media, has yet to fully address the implications of excessive publicity and digital dissemination in judicial processes.
