Licata fuel station authorization revocation suspended by Sicilian court

The Council of Administrative Justice for the Sicilian Region (CGA) has granted a precautionary request from GIAP Gestione Impianti Autonomi Petroli S. r. l., suspending a decision by the Municipality of Licata. The municipal order had declared the expiration of authorization titles for a fuel distribution plant located on Corso Umberto.

The dispute stems from a January 2026 administrative determination that revoked authorizations dating back to 2007 and 2018, which included permissions for public land occupation for customer parking. In its appeal to the President of the Sicilian Region, the company contested the revocation.

The CGA found merit in the company's arguments, noting a potential lack of adequate motivation and investigation by the municipality. The court observed that the municipal decision cited legal incompatibility under Law 124/2017 but failed to conduct a concrete evaluation of the facility's adequacy within its specific context or address the arguments presented by the company during the proceedings.
