Lidl ordered to withdraw sandals following Birkenstock trademark ruling
A Dutch court has ruled that the retailer Lidl must stop selling five models of sandals that infringe upon Birkenstock’s trademarks. The ruling specifically addresses the design of the sandal footbeds, which the court found to be unauthorized copies of Birkenstock’s iconic Arizona, Madrid, Gizeh, Boston, and Florida models.
In addition to withdrawing the products from sale, Lidl faces a penalty of 5,000 euros for every day the injunction is not met. The retailer is also required to provide Birkenstock with sales data regarding the disputed items and will be responsible for legal costs and damages, the amounts of which are to be determined in separate proceedings.
Birkenstock stated that the decision serves as a signal to manufacturers of imitations that attempt to profit from the company’s creativity and innovation. While the ruling is not yet final and Lidl retains the right to appeal, the company expressed satisfaction with the outcome as part of its ongoing efforts to protect its intellectual property.
