Lidl-Birkenstock trademark dispute in Netherlands

Overview

The District Court of Gelderland in Arnhem has ordered the discount supermarket chain Lidl to immediately cease selling five models of sandals that infringe upon Birkenstock’s copyrights. The ruling specifically targets products mimicking the Arizona, Madrid, Gizeh, Boston, and Florida styles, finding that Lidl violated protections related to the characteristic design of the footbed.

As part of the injunction, Lidl faces a penalty of €5,000 for every day the disputed products remain on sale. The retailer is also required to provide Birkenstock with detailed sales and order data for the items and must compensate the footwear brand for damages and legal costs, with specific amounts to be determined in separate proceedings.

Birkenstock expressed satisfaction with the verdict, stating it serves as a signal that manufacturers cannot ‘free-ride on Birkenstock’s creativity and innovation.’ The decision aligns with a December 2025 ruling by the Court of Justice of the European Union, which affirmed that industrial designs can qualify for copyright protection if they represent an author’s own intellectual creation. Lidl maintains the right to appeal the decision.
