Lucas do Rio Verde ordered to replace temporary health staff with exam passers

The Court of Justice has ruled that the Municipality of Lucas do Rio Verde must replace temporary health sector workers with candidates who passed recent civil service examinations. The decision follows a public civil action by the Public Prosecutor's Office, which argued that the municipality was bypassing qualified candidates by using simplified selection processes for temporary roles.

The legal dispute arose after the expiration of a partnership with the Association of Management and Programs (OSCIP-AGAP), which had managed health staffing since 2020. The Public Prosecutor's Office identified 164 temporary contracts for positions where qualified candidates were already awaiting appointment. The court determined that the end of the AGAP partnership was not an unpredictable event, as the contract had been extended multiple times over six years, allowing the municipality sufficient time to plan for permanent staffing.

In addition to replacing temporary staff, the ruling seeks to regularize health sector staffing levels and calls for new civil service exams for positions currently lacking active selection processes.
