Mexico Supreme Court permits personal cannabis edibles

Mexico’s Supreme Court of Justice (SCJN) has ruled that authorized recreational cannabis users are permitted to prepare cannabis-infused edibles for their own personal consumption. In a 7-2 vote, the Court ordered the Federal Commission for the Protection against Sanitary Risks (COFEPRIS) to authorize the preparation of cannabis in prepared and semi-prepared foods intended solely for individual use.

The ruling distinguishes between ordinary culinary activities—such as chopping, mixing, cooking, or frying—and the industrial manufacturing of products subject to specialized sanitary regimes. The Court found that incorporating cannabis into food for personal use constitutes a culinary transformation rather than the production of a regulated commercial product.

This decision does not extend to commercial purposes. The sale, distribution, supply, or transfer of cannabis-infused foods to third parties remains prohibited. While the Court clarified the scope of personal use, comprehensive legislative reform regarding the commercialization of adult-use cannabis in Mexico has yet to be fully implemented.
