Overview
Mexico’s Supreme Court of Justice (SCJN) has ruled that individuals with sanitary authorization for recreational cannabis use may legally prepare cannabis or THC in prepared or semi-prepared foods for personal consumption.
In a 7-2 vote, the Court distinguished between ordinary culinary activities—such as cooking, mixing, or frying—and the industrial or pharmaceutical manufacturing of products. The ruling establishes that incorporating cannabis into food for individual use constitutes a culinary transformation rather than the production of regulated commercial goods.
The decision maintains strict prohibitions on commercialization. The sale, distribution, supply, or transfer of cannabis-infused foods to third parties remains illegal. While the ruling clarifies the scope of personal use, comprehensive legislative reform regarding the commercialization of adult-use cannabis in Mexico has not yet been fully implemented. The Federal Commission for the Protection against Sanitary Risks (Cofepris) retains authority to regulate cannabis in products requiring specific sanitary controls, such as medicines, dietary supplements, and cosmetics.
