Mexico to introduce indigenous collective amparo law

The Mexican federal government will submit a bill to Congress establishing a new legal regime for Indigenous and Afro‑Mexican peoples. The proposal, part of the Ley General de Derechos de los Pueblos Indígenas y Afromexicanos, creates an "indigenous amparo" that extends the traditional individual‑rights injunction to protect collective rights, mandates mandatory consultation, grants legal personality and its own patrimony to communities, and sets out mechanisms for resource allocation and participation.

The initiative follows the historic development of the amparo remedy, which originated in the Yucatán Constitution of 1841 and was incorporated into federal law in the mid‑19th century to safeguard individual fundamental rights. By adapting the amparo to a collective context, the draft law aims to strengthen autonomy, land and cultural rights, and safeguards for vulnerable groups within Indigenous and Afro‑Mexican communities. The draft, prepared after 148 meetings with 35 federal agencies and civil society, is slated for presentation on 12 October.
