Mexico advances Indigenous and environmental rights

Mexico continues to advance legal frameworks for Indigenous and Afro-Mexican rights through federal and state-level initiatives. The proposed General Law on the Rights of Indigenous Peoples and Afro-Mexicans seeks to strengthen the autonomy of over 25 million people, allowing them to manage federal budgets directly and define their own normative systems.

As of September 2026, the Mexican Senate is prioritizing constitutional reforms to Article 2, which recognizes these groups as “subjects of public law” to strengthen their legal personality and self-determination. In Guadalajara, National Electoral Institute (INE) Counselor Rita Bell López Vences emphasized that constitutional recognition must be supported by resources and institutional commitment to guarantee the political-electoral rights of indigenous and Afro-Mexican women, ensuring participation is free from discrimination and traditional gender inequalities.

Implementation efforts are expanding through direct dialogue. Ulises Mejía Haro has met with representatives of the Wixárika people to discuss the protection of sacred sites and ancestral territories through Justice and Regional Development Plans, which aim to allow indigenous assemblies to execute their own priority works.

Furthermore, the National Institute of Indigenous Peoples (INPI) has begun facilitating regional assemblies for prior, free, and informed consultations. In El Fuerte, Sinaloa, the Mayo-Yoreme people and traditional authorities met with government representatives to discuss legislative elements such as legal pluralism, the protection of cultural heritage, and access to essential infrastructure.

However, the consultation process faces significant criticism. In Michoacán, Purépecha women’s collectives have characterized the process as a “simulation,” arguing it fails to meet international standards for informed consent. Critics cite the complexity of the 208-page proposal and concerns over whether it has been translated into the 68 national indigenous languages. Additionally, reports from the Pirinda people indicate instances of physical blockades preventing participation in regional forums.
