Mexico's San Luis Potosí governor moves to repeal AI criminal law

Governor Ricardo Gallardo Cardona of the Mexican state of San Luis Potosí submitted a legislative initiative that would eliminate the three AI‑related offenses introduced by the 2025 "Ley Serrano"—unauthorized use of AI‑generated image or voice, institutional manipulation, and deliberate disinformation. The proposal seeks to delete the entire chapter from the state penal code and later craft a new regulatory framework through a broad public consultation, stating that the repeal is not an admission of error but a step toward a more democratic approach to AI governance.

The state Congress has begun processing the repeal, with the Permanent Commission convened and an extraordinary session anticipated to vote on the bill. Critics had warned that the original law restricted freedom of expression and press activity, citing the first Mexican case in which journalists were charged under the statute. The repeal aims to remove those criminal penalties while reopening discussion on how to address digital manipulation and deep‑fakes without criminalising legitimate journalism.
