Ceuta government files Supreme Court appeal over migration crisis management

The government of Ceuta has filed a contentious-administrative appeal with the Supreme Court against the Spanish central government, alleging "inactivity" in managing the mass migration crisis that occurred on July 30 and 31, 2026. Local authorities, led by President Juan Jesús Vivas, claim the State has failed to deploy sufficient personnel and material resources to process expulsion, return, or international protection procedures for the migrants who entered the city.

Simultaneously, Judge María Tardón of the Audiencia Nacional has expanded her judicial investigation into the events. The probe aims to determine what information was available to authorities prior to the influx of an estimated 80,000 to 90,000 people. The judge has summoned three Ceuta government counselors and several police officers to testify as witnesses.

To reconstruct the sequence of events, the court has requested intelligence and security reports from the Ministry of Defense and the Armed Forces Intelligence Center (CIFAS) covering the period from July 15 to August 7. The investigation also includes requests for satellite imagery, drone footage, and video surveillance from the border, as well as information regarding a specific individual identified as a potential informant.
