Ministry of Home Affairs proposes new disciplinary rules for officials

The Ministry of Home Affairs has drafted a proposal to amend regulations regarding the disciplinary actions taken against officials and civil servants. The draft, currently being appraised by the Ministry of Justice, introduces new provisions concerning cases where disciplinary action may be deferred, excluded, or exempted.

A key component of the proposal aims to implement Resolution 29/2026 of the National Assembly. This resolution establishes specific mechanisms to handle land law violations committed by organizations or individuals prior to the effective date of the 2024 Land Law.

Under the proposed guidelines, officials, civil servants, or members of the armed forces may be exempted from discipline for land-related violations occurring before August 1, 2024, if the actions were taken for socio-economic development or national defense and security purposes, provided there was no corruption or loss of state assets. If assets were lost, exemption may apply if all consequences have been fully rectified.
