Montenegro imposes fines for unsolicited SMS and Viber advertising
In Montenegro, companies and mobile operators face fines ranging from 200 to 20,000 euros for sending unsolicited advertising via SMS or Viber without explicit user consent. According to regulations from the Agency for Electronic Communications and Postal Services (EKIP), consent must be obtained through written form, email, SMS, or other verifiable methods. If a user does not explicitly confirm acceptance via a reply to an initial electronic message, the sender is not considered to have permission for further communication.
Citizens can block unwanted promotional messages from banks, retailers, or telecommunications companies using the free electronic register ‘Ne zovi me’ (Do Not Call). If personal data is not deleted following a request to stop messages, individuals can escalate the issue to the Agency for Electronic Communications or the Agency for Protection of Personal Data, which has the authority to order the deletion of such data.
