Montenegro regulatory and financial law updates

Overview

Montenegro has implemented new regulatory measures targeting digital privacy and financial transparency. The Agency for Electronic Communications and Postal Services (EKIP) established fines between 200 and 20,000 euros for companies and mobile operators sending unsolicited advertising via SMS or Viber without explicit consent. To manage these communications, citizens may use the ‘Ne zovi me’ (Do Not Call) electronic register.

In a separate regulatory move, the government proposed amendments to the Law on Current and Capital Transactions to strengthen controls on cross-border transfers. These changes aim to prevent money laundering and terrorism financing by aligning national legislation with EU Regulation 2018/1672.

The draft law requires both residents and non-residents to declare cash being carried when entering or exiting the country. The proposal expands reporting obligations to include funds sent via postal or cargo shipments, requiring senders or recipients to report such transfers to customs authorities within 30 days of a request. The Central Bank of Montenegro will be responsible for prescribing specific cash limits. Proposed penalties for non-compliance include fines of up to 40,000 euros for legal entities and 8,000 euros for individuals.
