Morocco CNDP sets data and AI rules for 2026 elections

Morocco’s National Commission for the Control of Personal Data Protection (CNDP) has issued strict guidelines for political parties and data processors ahead of the legislative elections scheduled for September 23. The Commission emphasized that all personal data processing must be declared to the CNDP in accordance with Law 09-08, ensuring that data is used only for its intended purpose and within specified retention periods.

Specific protections were highlighted for data concerning political opinions, which requires explicit consent from individuals before use. The CNDP also warned against direct marketing or prospecting activities conducted without prior authorization.

Regarding technology, the Commission addressed the use of artificial intelligence in the electoral process, mandating that any content generated by AI must be clearly labeled. This requirement aligns with the Moroccan Penal Code and organic laws governing the House of Representatives. To support these regulations, the CNDP has established a dedicated hotline (3020) to provide guidance to citizens and political actors.
