Netherlands delays EPR wastewater obligations amid supply concerns

The Dutch government has decided to postpone the implementation of Extended Producer Responsibility (EPR) obligations under the European Directive on urban wastewater treatment. This delay comes as the government seeks greater legal certainty while awaiting a ruling from the Court of Justice of the European Union (CJEU).

The decision follows conclusions from the CJEU Advocate General, who proposed invalidating provisions that mandate the pharmaceutical and cosmetic industries to finance at least 80% of quaternary wastewater treatment costs. The Advocate General questioned the scientific and methodological basis used to assign these costs to these specific sectors.

The Spanish Association of Generic Medicines (AESEG) has welcomed the Dutch move, citing concerns that the EPR system could negatively impact the supply of medicines. The debate remains active in Europe, following legal proceedings initiated by pharmaceutical industry organizations in Ireland and a June resolution by the European Parliament calling for a new impact assessment and a temporary suspension of the system.
