Netherlands Minister calls for flexible student housing regulations

The Dutch Minister for Housing and Spatial Planning, Elanor Boekholt-O’Sullivan, has called on municipalities to adopt a more flexible approach regarding student housing regulations. She urged local governments not to strictly enforce every formal requirement for room rentals, provided there is no nuisance or negative impact on neighborhood livability.

This call follows tensions in Groningen, where ten students faced losing their housing due to permit issues involving sub-letting arrangements. The situation highlights how tightened regulations, originally intended to prevent ‘friends contracts’ used to bypass permit requirements, have inadvertently targeted long-standing, problem-free student residences.

Legal discussions also highlight the role of the ‘hardship clause’ within municipal housing ordinances. This clause allows for deviations from standard rules in exceptional cases where strict application would be unreasonable. Recent cases in The Hague have demonstrated instances where municipalities incorrectly refused to apply this clause, suggesting a need for greater administrative discretion in housing permit decisions.
