New York implements new safety requirements for data centers
Governor Kathy Hochul has announced new transparency and safety requirements for data center developers and operators in New York. Under the new rules, companies must report safety incidents to the newly established Office of Digital Innovation, Governance, Integrity and Trust (DIGIT) within 72 hours.
Additionally, operators are required to submit quarterly reports regarding potential catastrophic risks and biennial disclosure statements to the state government. These regulations are set to take effect on January 1, coinciding with the full implementation of the Responsible AI Safety and Education (RAISE) Act.
This move follows a moratorium on new data center developments exceeding 50 megawatts, which was implemented due to concerns regarding the public power supply and natural resource scarcity. The moratorium is currently expected to remain in place until July 2027.
