New York data center regulation and investment

Overview

New York has introduced new regulatory frameworks and oversight measures concerning data center development and community impact.

Initially, Governor Kathy Hochul announced a Host Community Investment Framework designed to help local governments negotiate benefits from data center investments. This framework recommends a benchmark of $1 million for every megawatt of utility demand to fund local infrastructure, such as schools and roads, while promoting local hiring and environmental transparency.

Following this, the state implemented stricter safety and transparency requirements. Developers and operators must now report safety incidents to the Office of Digital Innovation, Governance, Integrity and Trust (DIGIT) within 72 hours, alongside submitting quarterly risk reports and biennial disclosures. These regulations, set to take effect January 1, coincide with the implementation of the Responsible AI Safety and Education (RAISE) Act. These measures follow a moratorium on new data center developments exceeding 50 megawatts, which remains in place until July 2027 due to concerns over natural resource scarcity and the public power supply.
