North Rhine-Westphalia implements new building regulations

North Rhine-Westphalia is implementing a new state building code (BauCode NRW) effective September 1, 2026, aimed at simplifying construction processes and accelerating permit approvals.

A key feature is the introduction of 'approval fiction' (Genehmigungsfiktion). Under simplified procedures, if the building authority fails to issue a decision within the statutory six-week period, the building permit will be deemed granted, provided specific legal requirements are met.

Additional reforms include the standardization of digital building applications, replacing previous written requirements. The new regulations also significantly reduce bureaucratic burdens by eliminating approximately 90 percent of DIN standards, limiting mandatory technical rules to essential safety regulations. Furthermore, the reform abolishes the requirement for double building surveys by utilizing digital data and the 'XBau' standard, which is estimated to reduce surveying costs by roughly 20 percent. These measures are intended to facilitate the conversion of existing buildings to create more housing.
