Overview
North Rhine-Westphalia is implementing a new state building code (BauCode NRW) effective September 1, 2026, designed to simplify construction processes and accelerate permit approvals.
A central component of the reform is the standardization of digital building applications. In the Oberbergischer Kreis district, for example, the transition to exclusively digital submissions becomes mandatory on the effective date, as paper applications will no longer be processed. This shift aims to increase transparency and efficiency by reducing paperwork.
The new regulations also introduce ‘approval fiction’ (Genehmigungsfiktion), where a permit is deemed granted if authorities fail to issue a decision within a statutory six-week period under specific conditions. Other reforms include reducing bureaucratic burdens by eliminating approximately 90 percent of DIN standards, limiting mandatory technical rules to essential safety regulations, and utilizing the ‘XBau’ standard to reduce surveying costs.
Following the implementation of the code, the Architects' Chamber and the Chamber of Engineers-Construction of North Rhine-Westphalia, in collaboration with the Ministry for Home Affairs, Municipal Affairs, Building and Digitalization, launched a digital synopsis of the state building regulations (BauO NRW). This digital tool is intended to help professionals compare current regulations with previous versions and view legislative justifications, further aiming to increase transparency and reduce bureaucratic hurdles.
